Terms and Conditions

1. Definitions

"Buyer" Means the Customer.
"Seller" Cats2u
"Goods" Means the articles or things described in the Order.
"Order" Means the Order placed by the Buyer for the supply of the Goods. 

2. Buyer's Order

a) Acceptance of Terms & Conditions. These Terms and Conditions apply to all contracts of sale by the Seller unless varied in writing. The placing of an Order for Goods shall be deemed conclusive evidence of the Buyer's acceptance of these Terms and Conditions. Nothing in these Terms & Conditions shall be construed as affecting the statutory rights of the Customer.

b) All Orders placed by the Buyer for purchases of Goods from the Seller are subject to acceptance by the Seller by delivery of the Goods to the Buyer at which point a legally binding contract is constituted between the Buyer and the Seller.

c) The processing of your payment and acknowledgment of your Order (including sending you an email confirming your Order is being processed) does not constitute legal acceptance of your Order.

d) Occasionally there may be information on our site that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update the information or cancel Orders if any information is inaccurate at any time without prior notice (including after you have submitted your Order).

e) Where any Goods ordered are not available, or when an Order contains Goods from different manufacturers, the Seller reserves the right to substitute the Goods for an equivalent or superior product without prior notice. 

f) Supply of vehicle identification details. You must supply the vehicle registration or chassis number when placing your Order. Failure to do so may delay the processing of your Order and the delivery of your Goods. Whenever possible the Seller will check that the Goods ordered are correct for the vehicle details supplied but ultimately it's the Buyer's responsibility to ensure that they have ordered the correct part.

3. Delivery

a) Orders placed before 4pm Monday to Thursday will be dispatched the same evening for next day delivery. Orders placed before 4pm on Friday will be delivered on Monday unless Saturday delivery is selected. Orders placed anytime over the weekend will be dispatched on Monday for delivery on Tuesday. Suggested delivery dates and promises of delivery are made in good faith and every effort will be made to keep to delivery dates given but time and place of delivery shall not be the essence of this contract and the Seller shall not be liable for any loss caused through delay or failure to deliver. The delivery charge is per order rather than per item, however should your order contains items from different manufacturers or lengthy exhaust parts the shipping amount charged may be insufficient. Should the shipping charge paid be insufficient we will send you a payment request for the additional amount or if you prefer we will cancel your order and refund your payment. 

b) If the Buyer Orders Goods from the Website for delivery outside of the UK, they may be subject to import duties and taxes which are levied when the Order reaches the specified destination. The Buyer will be responsible for payment of such import duties and taxes. The Buyer should note that the Seller has no control over these charges and cannot predict their amount. The Buyer should contact their local customs office for further information before placing an Order. Should the Order be returned due to unpaid customs charges the Order will be credited less the outward delivery charge. If you request for the Order to be resent then another delivery charge will be applied.

4. Cancellations, Returns & Refunds

Any Order cancelled prior to dispatch will be refunded in full. If you would like to request to return an item please access the Contact Us section of the Website. Your return request must be submitted in writing within a period of 14 days, beginning with the day on which the item was delivered. The item must me unused, undamaged and packed securely in the original packaging. The item must be returned to the address that we email to you so that it is received within 28 days beginning with the day on which the item was delivered. We are under no obligation to accept returns outside of the time frame previously mentioned. In some cases we may accept a late return but it will be subject to a 25% handling charge. All returned parts manufactured by Cats & Pipes will incur a 15% handling charge. For your protection, we recommend that you use a trackable delivery service. Please note that you will be responsible for the cost of returning the Goods. We will not accept any responsibility for items lost or damaged during return transit. Once the returned item is received we will refund the relevant part of the purchase price for that item. 

5. Damage

The Seller does not accept responsibility for any damage, shortage, or loss in transit unless any such damage, shortage or loss in transit is notified to the Seller, by email, within 3 days of the date of delivery. All claims for non-delivery must be notified to the Seller, by email, within 10 days of the date of dispatch. All other claims must be notified to the Seller, by email, within 14 days of receipt of the Goods. In the absence of such emailed notification of claims, within the periods aforementioned, the Goods shall be deemed to have been delivered in accordance with the contract. Please be aware that exhaust silencers are delivered direct from the manufacturer and will arrive without any packaging and as such may sustain minor damage during transit. Such cosmetic dents and scratches will not in any way affect the performance of the part or the manufacturer 2 years warranty.

6. Warranty and Defects

All Goods supplied by the Seller are new and covered by a manufacturer’s warranty. Any Goods supplied by the Seller that are subsequently agreed by the Seller to be defective in design, materials or workmanship will be either replaced under the warranty or the Goods collected and the Buyer refunded. If a part is replaced under warranty the replacement part is covered for the remaining term of the original warranty. The faulty part must be returned otherwise the warranty claim is invalid and no replacement or credit will be given. Should a replacement unit be supplied in advance of receiving back the faulty part and the Buyer fails to return the faulty part an invoice for the replacement unit will be sent to the Buyer for payment. The aforementioned warranties do not apply to damage to the Goods caused by misuse, faulty workmanship, faulty vehicle, operation beyond the limits of rated capacity, neglect or default in the use or application of the Goods. Any part modified in any way without prior authority invalidates the warranty. If you have reason to believe that the part purchased is faulty you must first complete the Warranty replacement request form located in the Contact Us section of the Website supplying the relevant documentary and photographic evidence as required.

7. Emissions Test Failure Warranty

If a car fails the emissions test due to an under-performing catalytic converter the only reading that will be too high will be the CO percentage. If the HC level is too high this relates to a poorly performing engine. HC is unburned, or partially burned hydrocarbons. In gas analysis, these hydrocarbons can come from two sources. Firstly, the engine may be worn and passing oil into the combustion chamber, which cannot be fully burned. Secondly, the engine may have developed a misfire, or suffer from only partial combustion of the fuel. This unburned fuel registers as HC on the gas analyser (hydrocarbons, is an indication of unburned fuel exiting the exhaust, the more incomplete the combustion, the higher the HC reading). Please be aware that even though the MOT emissions test allows up to 200 ppm for the HC reading any reading higher than 50 ppm means that the vehicle has a problem that needs rectifying and the manufacturers of the catalytic converters we supply will not accept warranty claims for emissions failure if the HC level is above 60 ppm. If a car fails the Lambda test this usually means that either the engine is running very rich or has an air leak. The perfect Lambda reading is 1. A reading lower than 1 shows that a car is running rich. A reading higher than 1 shows that the engine is running lean or that there is an air leak in the system. A vehicle with a high HC reading and a low Lambda reading will almost certainly have high CO but the cause is unlikely to be a faulty catalytic converter. To instigate a warranty claim for emissions failure you MUST supply a copy of the engine emissions test failure report.

8. Diesel Particulate Filter Warranty

A DPF is only covered under the warranty for structural failure. A blocked DPF is not covered by the warranty as the problem originates upstream of the DPF.

9. Consequential Loss

Notwithstanding anything contained herein the Seller shall not be liable, under any circumstances, for labour costs, loss of profit, delays in delivery, any direct or indirect consequential loss of any kind whether caused by manufacturing defect, negligence or otherwise. All conditions and warranties whether expressed or implied are hereby excluded save only those which by statute may not be excluded.

10. Price Beater

Whilst endeavouring to be competitive, our price beater policy is subject to our discretion, and we reserve the right to decline an offer to beat a competitor’s price.
